ANTRIM COUNTY ELECTION COMMISSION                          Monday, June 18, 2007

 

            Due to a conflict, the meeting was moved to Room 203B on the second floor of the County Building.

 

            The sponsors of the recall wording petitions handed out information for perusal by the Election Commission members.

 

            Norman Hayes, Chairman, called the meeting to order at 8:50 a.m. in the Commissioners Room of the County Building.

 

Present:  Judge Norman Hayes, County Clerk Laura Sexton, County Treasurer Sherry

              Comben.

Also present:  Kent McNeil, Charles Koop, Jerry Green, Glenn Frantz, Steve Mikowski, Arlen Turner, and Dan Bean.

 

            Chairman Hayes reported that Sandra Davis would be acting as court reporter for the Clarity Hearing.

 

            Chairman Hayes explained the purpose of the Clarity Hearing.

 

            The County Clerk read the wording on the recall petition submitted by Jerome Greene for the recall of Charles H. Koop, Prosecuting Attorney.

                       

            There was a question raised in regard to the Greene submission:  can an individual who is not a resident of Antrim County submit recall wording for an elected official in Antrim County?

 

            The County Clerk read a statement of an opinion on that subject which was obtained from David Foster of the Bureau of Elections in Lansing  which indicated that the filer of recall wording had to be a voter in the district which the subject of the recall represents.

 

            It was moved by Sexton, seconded by Comben the submission of recall wording by Jerome Greene for the recall of Charles H. Koop, Prosecuting Attorney, be denied because Mr. Greene is a resident of Kalkaska County.  Motion carried by a yea and nay vote as follows:  Yes – Comben, Hayes, Sexton;  No – None;  Absent – None.

 

            The County Clerk read the wording on the recall petition submitted by Glenn Frantz for the recall of Charles H. Koop, Prosecuting Attorney.

 

            It was moved by Sexton, seconded by Comben the submission of recall wording by Glenn Frantz for the recall of Charles H. Koop, Prosecuting Attorney, be denied because Mr. Frantz is a resident of Kalkaska County.  Motion carried by a yea and nay vote as follows:  Yes – Comben, Hayes, Sexton;  No – None;  Absent – None.

 

            Chairman Hayes gave an explanation clarifying his reason for requesting that uniformed police officers be present at the recent Clarity Hearings.

 

            The County Clerk read the wording on the recall petition submitted by Kent McNeil for the recall of Charles H. Koop, Prosecuting Attorney.

 

            Chairman Hayes requested comment from the public.  Comments on the wording were offered by Charles Koop and Kent McNeil.  Other comments were offered by Glenn Frantz and Jerome Greene.

 

            It was moved by Comben, seconded by Sexton the wording on the recall petition submitted by Kent McNeil for Clarity Hearing and naming Charles H. Koop as the individual to be recalled be declared clear.  Motion carried by a yea and nay vote as follows:  Yes – Comben, Sexton;  No – Hayes;  Absent – None.

           

            The meeting adjourned at 9:50 a.m.
