ANTRIM COUNTY ELECTION COMMISSION                      Tuesday, June 6, 2006

 

            Norman Hayes, Chairman, called the continuation of the June 5, 2006 meeting to order at 9:00 a.m. in the Commissioners Room of the County Building.

 

Present:  Judge Norman Hayes, County Clerk Laura Sexton, County Treasurer Sherry

              Comben.

Also present:  Larry Eckhardt, Dennis Thier, David Kotwick, Lela Clark and other

                       residents of Central Lake Village.

 

            The Clerk presented a faxed communication from Greta Powers, Central Lake Village Clerk which informed of the following.

            Dennis Thier’s term of office – Mar. 12, 2002 until Nov. 7, 2006.

            Lawrence Eckhardt’s term of office – Mar. 9, 2004 until Nov. 7, 2006

            Lela Clark’s term of office – Mar. 9, 2004 until the first Tues. of Nov, 2008

            David Kotwick’s term of office – Mar. 9, 2004 until the first Tues. of Nov. 2008

 

            The Chairman informed that under MCL 168.951 any elected official cannot be recalled during the first six month in office or the last six months in office.

 

            Ralph Hines offered to withdraw the wording on petitions for Lawrence Eckhardt and Dennis Thier.

 

            It was moved by Comben, seconded by Sexton that the request for Clarity Hearing on the wording on recall petitions for Lawrence Eckhardt, Central Lake Village President and Dennis Thier, Central Lake Village Council Member, is denied because each of these officers is in the last six months in office.  Motion carried by a yea and nay as follows:  Yes – Comben, Sexton, Hayes;  No – None;  Absent – None.

 

            The Clerk and Chairman explained the purpose of the Clarity Hearing on wording on recall petitions and cited case histories.

 

            The Clerk read the wording on the recall petition for David Kotwick, Central Lake Village Council Member (see attached).

 

            David Kotwick spoke, maintaining that item one in the wording occurred before he was a council member, and items two and four were conclusory statements and therefore, not viable recall language.

 

            Ralph Hines defended the language, indicating it represented the opinion of the majority of the people in Central Lake Village.

 

            Lela Clark gave a brief history of her association with the Master Plan on the Village of Council and indicated the recall language should not be declared clear.

 

            There was a statement from Dennis Thier against the recall language and a statement from Denise Arnold for the recall.

 

            It was moved by Sexton, seconded by Comben the language on a recall petition for David Kotwick, Central Lake Village Council Member, be declared unclear.  Motion carried by a yea and nay vote as follows:  Yes – Comben, Sexton, Hayes;  No – None;  Absent – None.

 

            The Clerk read the wording on a recall petition for Lela Clark, Central Lake Village Council Member. 

 

            It was moved by Comben, seconded by Sexton the language on a recall petition for Lela Clark, Central Lake Village Council Member is declared unclear.  Motion carried by a yea and nay vote as follows:  Yes – Comben, Sexton, Hayes;  No – None;  Absent – None.

 

            The meeting adjourned at 9:30 a.m.
