ANTRIM COUNTY

ORDINANCE NUMBER ONE OF 1984

 

            WHEREAS the waters flowing under and adjacent to the Torch River Bridge and Clam River Bridge are frequently used by boat traffic and it appearing that public safety can be jeopardized by persons fishing or throwing or dropping items from the Torch River Bridge and Clam River Bridge and by persons diving from these bridges and whereas the Torch River Bridge and Clam River Bridge are part of the County road system under jurisdiction of the Antrim County Road Commission,

 

            Therefore, the County of Antrim ordains:

 

Section 1:         Definitions

           

            The term “Torch River Bridge", as used in this ordinance means, the bridge which spans Torch River and is adjacent to Milton Township, Antrim County, and includes the abutments and sloped walls at each end of the bridge.

 

            The term “Clam River Bridge", as used in this ordinance means, the bridge which spans Clam River between Helena Township and Forest Home Township, Antrim County and includes the abutments and sloped walls at each end of the bridge.

 

Section 2:         Action Prohibited

 

            It shall be unlawful for any person to:

 

            1.         Fish from the Torch River Bridge or Clam River Bridge,

 

            2.         Jump or dive from the Torch River Bridge or Clam River Bridge,

 

            3.         Throw or drop any item from the Torch River Bridge or Clam River Bridge.

 

Section 3:         Penalty

 

            Any person convicted of violating this ordinance shall be subject to a penalty which shall not exceed a fine of $100.00, or imprisonment for 90 days, or both.

 

Section 4:         Effective Date

 

            This ordinance will take effect in 90 days from the date hereof.

 

RESOLUTION

 

            At a regular meeting of the Antrim County Board of Commissioners, Antrim County, Michigan, held in the Antrim County Building located in Bellaire, Michigan on January 12, 1984.

 

                        PRESENT:       Darwin Penfold, Charles Huntly, Josephine Bargy, Jack White,

                                                 James Baker, Herbert Nothstine

                                                Curtis Patrick, Wayne Steiner, S. Ward Babcock

 

                        ABSENT:        William Cronin, Gale Murphy

 

 

            The following resolution was offered by James Baker and supported by Jack White.

 

            The Antrim County Board of Commissioners hereby adopts Ordinance Number 1 of 1984 and ordains as follows:

                        (See “Attachment A” for the full provisions of Ordinance Number 1 of 1984.)

 

            IT IS FURTHER RESOLVED that this Ordinance Number 1 of 1984 of Antrim County shall be effective thirty (30) days from the date hereof and this Ordinance Number 1 of 1984 shall be published within fifteen (15) days in the Antrim County News.

                        I, the undersigned, the Antrim County Clerk, Antrim County, Michigan, do hereby certify that the foregoing is a true and complete copy of certain proceedings taken by the Antrim County Board of Com missioners of said County at its regular meeting held on January 12, 1984, relative to adoption of the ordinance therein set forth; that said meeting was conducted and public notice of said meeting was given pursuant to and in full compliance with the Open Meetings Act, being Act 267, Public Acts of Michigan, 1976, and that the minutes of said meeting were kept and will be or have been made available as required by said Act.
