Al Martel called the meeting to order at 7:10 p.m. |

Public Comment None.
The Committee discussed dropping the ordinance and adopting Part 91 of the statute and keeping the guidelines.
Charlie Koop, Legal Counsel, indicated that in his opinion you can't adopt the guidelines without having an ordinance. He also indicated the ordinance could, for the most part, mirror the State statute.
Minutes Motion by Jim Gurr, supported by Heidi Lang, to approve the minutes of September 13, 2006 with an amendment to add (immediately after where the minutes say, “Heidi opened the Committee for discussion of the ordinance”), “The Committee discussed the advisability of discontinuing the ordinance and simply enforcing the State law, but decided to continue to work on the ordinance.” Motion carried – unanimous.
The Committee continued review of the ordinance starting with Section 3-701.
4-104 Change, "... may notify, upon request, a local unit of government or State agency with jurisdiction..."
5-103 Before the word wetland add the word, "regulated". Also, put "regulated" in front of each instance where the ordinance says "wetland".

5-106 Remove this section.
6-102 Change residential unit to “residence”. Remove "...or in an environmentally sensitive site)..." in the parenthetical part of the section.
Suggestion: Major Earth Change - Three acres or more. Minor Earth Change - Less than three acres.
6-201 Change to read: “A site
plan for a single residence
6-201.1 Change as follows:
“…and/or wetlands within the boundaries of the site
1-100 Alan Martel suggested the following language be added to clear up any confusion regarding stormwater control through the soil erosion ordinance: The intent of this ordinance is not to regulate the movement of stormwater except as it may result in soil erosion and sedimentation. (Last sentence of the first paragraph).
The Committee ended before tackling section 6-202.
Alan Martel reminded the Committee that this was the last published meeting advertising for public input. The Committee decided to meet twice a month from now on, with the next meeting on October 19 at 7:00 p.m. The next two meetings will be on October 30 and November 8 also at 7:00 p.m.

A notice will be published in the paper. There will be one notice for all of the meetings. It will indicate the Committee continues to work on the ordinance and that anyone is welcome to provide input on the ordinance. We will also post the meetings.
